A few days ago, the Madhya Pradesh government announced a law against Love Jihad. A similar law will be introduced in Uttar Pradesh. Its draft has been prepared. -File photo.

On the lines of Madhya Pradesh, Uttar Pradesh is also preparing to enact a strict law to stop love jihad. Home Department has sent a proposal to the Department of Justice and Law. Case will be registered in non-bailable sections and if found guilty, there will be a rigorous sentence of 5 years. Chief Minister Yogi Adityanath had sought a report from the Home Department after the incidents of frequent love jihad in several cities of UP including Kanpur, Baghpat, Meerut. The draft law will be placed in the cabinet after review.

Draft changes 3 times, penalties added in last change

Chief of UP’s Law Commission Aditya Nath Mittal said that the Indian Constitution gave religious freedom, but some agencies were misusing it. They lure people of marriage, jobs and lifestyle to convert. We had submitted the draft on this issue in 2019 itself. Three changes have been made in it so far. In the last change, we have added the provision of punishment.

Marriages are being done for religious conversion also

  • According to the draft, marriages done for conversion or conversion due to wrong intentions for marriage will also come under the conversion law.
  • If someone gives mental and physical torture to someone to convert, then that too will come under the purview of this new law.
  • If in case of conversion, parents, siblings or other blood relations complain, then action can be initiated on their complaint.
  • If found guilty for conversion, the punishment can range from one year to five years.

Application for change of marriage to DM for one month before application
According to the draft, those who cooperate in cases like Love Jihad will also be made the main accused and will be punished if found guilty. There is a provision of punishment for those who convert for marriage. If someone wants to change the religion for marriage of his / her choice, then he / she has to give the application to the collector a month in advance. This application will be mandatory.

Politics is not right in every case

SP spokesperson Anurag Bhadauria said that if any person in India exploits a woman by hiding her identity, marrying, then it is a crime. He should be punished in this. Should be in the provision of law. But the government of the Bharatiya Janata Party believes less in politicizing the woman in giving justice to the woman. This is a matter of great concern in today’s society.

8 states have conversion laws
There are currently laws in 8 states of the country to curb conversion. This includes Arunachal Pradesh, Odisha, Madhya Pradesh, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand and Uttarakhand. First Odisha enacted this law in 1967.
