The Supreme Court on Wednesday issued a guideline to give maintenance charges, ie, maintenance allowance to the victim in marital relationship disputes. Accordingly, both the parties will have to give all the information related to their income to the court through an affidavit. Full details of the property will have to be given.

Justices Indu Bhushan and Subhash Reddy issued these guidelines. The court said, these guidelines have to be followed by all courts. Its purpose is to avoid different types of decisions in maintenance charge cases. The court said that in all cases, alimony will be awarded from the date of filing the petition in the court. The court will decide the amount of alimony. Even after the order, those who do not give alimony will also be punished.

What is the whole matter?
The petition filed against a decision of the Delhi High Court was being heard in the Supreme Court. In this case, the Delhi High Court had asked the husband to give alimony to his wife and child. In this, the High Court had also seen the husband’s Facebook post. In which he is seen touring different countries and doing wild life photography with expensive cameras. The court said that the wife also has the right to live this lifestyle.

These major things in the Supreme Court guidelines

  • Both husband and wife will have to disclose all their income and assets from the date on which the petition for maintenance allowance is made.
  • Until the full details of income and assets are revealed, the process of arrest or sending to jail will be stopped due to non-maintenance of allowance.
  • All high courts of the country will also follow this guideline and settle disputes.
  • Non-payment of alimony may be punishable even after a court order.
